Wills & Probate

Have you made your will? Have you been asked to act as executor of a will?

Make an Enquiry

Our Wills & Probate department offers a comprehensive service, encompassing all aspects of Estate Planning from the early stages of drafting all types of wills, advising on the various tax implications involved with leaving bequests including real property or personal property to loved ones or in transferring the family business or family farm to loved ones.

We also assist and advise in the extraction of Grants of Probate or Administration and indeed in the administering of the Estate and in ensuring the wishes of the Testator are complied with. We also advise persons who are unsure of their entitlements following the death of a loved one.

The Importance of Having a Will

A will is an extremely important document and it is the best way of ensuring that your wishes are fully complied with in the event of your passing. In spite of this, arranging to have a Will drafted tends to be the one act many of us delay doing for obvious reasons.

Having a Will in place not only helps to ensure your wishes are complied with; it also helps to give some comfort and clarity to those left behind. Our team are here to help make the process of drafting a Will as painless and confidential as possible.

We will ensure that the Will meets all of your requirements and that it is properly made and executed. We will advise on the best ways of avoiding any disputes surrounding this important document following your passing and we will also endeavour to minimise tax implications that may be associated with leaving gifts of real or personal property or involved in the transfer or break up of family businesses and farms. We are also happy to advise on the drafting of any trusts (including discretionary and specific purpose trusts) together with any tax implications associated therewith.

Executors & Administrators

If you have been entrusted as an Executor (in cases where there is a Will in place) or an Administrator (where there is no such Will) it can be a very confusing and unnerving situation to be in. You want to follow the wishes of the deceased person to the letter but you are unsure of what to do and how to do it. We will be there to hold your hand through every step of the process and offer sound advice along the way.

If you are thinking of making a will or wish to discuss planning your Estate or if you have the responsibility of being the Executor or Administrator of an Estate and are seeking some advice, please feel free to contact us and come see us in our Limerick office.
